The Decision of the Standing Committee of the National People's Congress on Amending the Work Safety Law of the People's Republic of China, adopted at the 29th Session of the Standing Committee of the 13th National People's Congress of the People's Republic of China on June 10, 2021, is hereby promulgated and shall come into force as of September 1, 2021.

Amended in accordance with the Decision on Amending Some Laws adopted at the Tenth Meeting of the Standing Committee of the Eleventh National People's Congress on August 27, 2009;

Amended the second time in accordance with the Decision on Amending the Work Safety Law of the People's Republic of China adopted at the Tenth Meeting of the Standing Committee of the Twelfth National People's Congress on August 31, 2014;

Amended for the third time in accordance with the Decision on Amending the Work Safety Law of the People's Republic of China adopted at the 29th Meeting of the Standing Committee of the 13th National People's Congress on June 10, 2021.

New additions to the new Work Safety Law are as follows:

1. Further clarify that the main person in charge of the production and operation unit is the first person responsible for safety production of the unit.

2. Explicitly and generally increase the amount of fines for violations.

3. Increase the dual prevention mechanism of multi-level security risk control and hidden danger investigation and management, joint prevention and control of major security risks, and identification and assessment of danger sources.

4. Timely close down production and business units with serious violations according to law and revoke relevant licenses.

5. Construction projects in some industries shall not illegally transfer construction qualifications, and shall not illegally subcontract.

6. Catering and other industries to install combustible gas alarm devices.

In view of the safety hidden by gas users in catering and other industries, as well as the non-standard use of alarm equipment related to safety production, the 33th article is changed to the 36th article, and two paragraphs are added as the third and fourth paragraphs:

"Production and business units shall not shut down or destroy monitoring, alarm, protection and life-saving equipment and facilities directly related to production safety, or tamper with, conceal or destroy their relevant data and information."

"Where production and business units in catering and other industries use gas, combustible gas alarm devices shall be installed and their normal use guaranteed."

The new amendments to the Work Safety Law have increased penalties for production and business units and persons in charge of violations

Article 99

Where a production or business entity commits any of the following acts, it shall be ordered to make corrections within a time limit and imposed a fine of not more than 50,000 yuan; Those who fail to make corrections within the time limit shall be imposed a fine of not less than 50,000 yuan but not more than 200,000 yuan, and the persons directly in charge and other persons directly responsible shall be imposed a fine of not less than 10,000 yuan but not more than 20,000 yuan; If the circumstances are serious, they shall be ordered to stop production and business for rectification; If the case constitutes a crime, criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law:

(8) The production and business units of catering and other industries use gas without installing combustible gas alarm devices.

Prevention is better than cure, and safety is more important than Mount Tai. The "Safety Production Law" adds new food and beverage safety prevention norms, reflecting the state's attention to the catering industry and the determination to prevent disasters and accidents.
